I imagine you have heard of a bill proposed by Sen. Steve Nass & Rep. Jesse Kremer that will limit transgender students’ access to bathrooms that correspond to their gender identities. This bill is discriminatory and further stigmatizes transgender and intersex youth, who already face disproportionate levels of discrimination, harassment, and bias from teachers, community members, and often peers and family members.

Numerous studies have shown that transgender students face high rates of discrimination and harassment in schools already. This bill further perpetuates negative beliefs about transgender students by insinuating they are sexual predators, when in fact they are just trying to avoid harassment and violence by using a bathroom that aligns with their gender identity. There is no reason to add to their negative experiences by forcing them into bathrooms that are not aligned with their gender identity, and to open schools up for litigation from transphobic parents.The false fears mentioned by the legislators who proposed this bill are not based in facts. As Brian Juchems, GSAFE’s Sr. Director of Education and Policy, reported, “In the nearly 60 Wisconsin school districts that follow best practices, no incidents have been reported of a non-transgender student being harassed.”Additionally, in the over 15 states that have modernized their pupil nondiscrimination policies to include specific protections for transgender students there have not been any substantiated reports of increased harassment towards students who are not transgender.
